Introduction:
Throughout this document Development Titan, LLC., also publicly identifiable as devTitan.com, is referenced as "our", "we","devTitan", or "us". The client, customer, or end user is referenced as "you", "your", or "the client".
Terms of Service:
The client, customer, end user, or representative of; verifies their authoritization and right to engage in business activities on behalf of their constituents or corporate entity. By signing or entering into agreement with devTitan, you (the signor of any contractual agreement) personally assume all legal & financial responsibility should any dispute arise. In addition to, you release devTitan from any liability or damages caused by your use of our services or any situation beyond our control such as: technical issues, technical or software incompatibilities, acts of god, power outages, or lack of cellular service at any given time.
Definition of Remote Service:
Remote services are not an "inhouse" or dedicated on-site service. We operate remotely, off-site, and via electronic forwarding. Any services which require our on-site presence will be handled as needed in order of priority at our devTitan's descretion to accomodate all of devTitan's clients in a quick and efficient manner.
Warranties & Representations:
(Section A: Hosting) Although devTitan's uptime status is beyond comparison and our double back up of all client files and web hosting data, no claim or warranty is or shall be made to guarantee 100% uptime.
(Section B: Remote Services) The registration of specific or requested local or toll free phone numbers is not guaranteed by devTitan nor should the immediate use of such telephone numbers be expected by the client. We will make every effort to offer a timeline and make the client aware of any such changes to service which are beyond our control or may effect their daily business activities.
Use of Services:
Your continued use of, or subscription to our services shall be accepted by devTitan as the clients desire to continue the use of our services & agree to all applicable fees. The term length of our contractual agreement should the client be subscription based will be renewed indefinitely provided devTitan is not notified of interest to cancel or modify services.
Ownership:
(Section A: Hosting) The client is not owner of, nor inherits any complete right to, or is granted unlimited access to devTitan's: bandwith, computer systems, databases, hard drive or hosting space, nameservers, or DNS settings.
(Section B: Remote Services) Any local or toll free telephone numbers registered by devTitan shall remain the property of devTitan indefinitely for any reason up to and including: termination of service or cancellation by the client.
Cancellation:
You understand and agree that cancellation of your subscription is your sole right and remedy with respect to any dispute with us. This includes, but is not limited to, any dispute related to, or arising out of: (1) any term of this Agreement or devTitan`s enforcement or application of this Agreement; (2) any policy or practice of devTitan, including devTitan's Privacy Policy, or devTitan`s enforcement or application of these policies; (3) the amount or type of fees, applicable taxes, billing methods, or any change to the fees, applicable taxes, or billing methods.
Privacy Statement:
devTitan guards the security & information of our clients to the highest standard. All computer systems and hard drives are updated regularly to run the most secure and proven software available. We employ AntiVirus, AntiMalware, Operating System Firewall, and third party Firewall software, in addition to our hardware internet gateway based firewall. Any mobile documents are saved on AES-256 bit encrypted, password protected data drives to prevent intrusion in the event of loss or theft. We at no time; will sell, seek to profit of, or distribute any information about our clients unless approved in writing by the client for our own promotional materials such as customer testimonials or work references. Your privacy is of our highest priority. Any and all data, if collected, such as: call volumes or domain traffic will be for operational purposes only, in the event our services require it.
Revisions:
It remains the sole responsibility of our customers and the client to review our Terms of Service. devTitan will in good faith attempt to contact all of our customers to notify them of any changes to our Terms of Service, at which point the customer may agree or decline continued service. The conditions within our Terms of Service are to be amended to any signed contractual agreement with the client.
